1.2  Obscure is the data controller for all personal data processed through the Site. We are responsible for deciding how we hold and use personal data we collect or receive about you. We respect your privacy and are committed to protecting your personal data. We will ensure that your personal data is stored and used in accordance with this Privacy Policy.

1.4  Our website and app are not intended for children (anyone under the age of 18), and we do not knowingly collect data relating to children. No one under age 18 may provide any information to or on the website or our app. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this website or our app or through any of its features, register on the website or our app, make any purchases through the website or our app, use any of the interactive or public comment features of this website or our app, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. 2 Data We Collect

2.1  Personal data is any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

2.2  Whenever we collect, store, use, disclose, or delete your personal data, this is referred to as processing your personal data. As a website user, visitor, customer, or app user, we will process different kinds of personal data about you which we have grouped together as follows:

  • Identity Data – data which identifies you including your name, title, username, date of birth, and gender​

  • Contact data – your contact details such as your billing address, delivery address, email address, and telephone numbers.

  • Purchase data – information concerning the products you have purchased from us including how frequently you purchase from us, whether you have used any discount or gift card codes or other offers, which products you have purchased, how much you have spent with us.

  • Social Media data – data you provide to us directly about your social media accounts or which we have access to when you connect with us, like or follow our social media accounts, including your social media handle, photograph, date of birth, location, occupation, interests, and other information and content you make available via your social media accounts.

  • Financial Data – Payments are processed by third-party providers (e.g, Wix Payments, PayPal, Stripe). We do not store full card details.

2.3  We do not collect any special categories of personal data about you (such as information about your health, race, political opinions, religious beliefs, or sexuality). Nor do we collect any information about criminal convictions and offences.

2.4  Our website is built and hosted on Wix.com Ltd. Wix acts as a data processor, and we remain the data controller. As part of operating the Site, Wix processes and stores personal data on our behalf, including:

  • Customer accounts;

  • order details;

  • delivery information;

  • analytics data;

  • messages submitted through forms; and

  • IP & device information.

Our third-party ecommerce website provider (currently Wix), whose services enable us to process electronic orders and payments for products, and other providers of technical, payment, and delivery services.

4 How We Use Your Data

4.1  We will need to process your data when you purchase products from us in order to process and deliver your order. We are likely to process your Identity, Contact, Purchase and Customer Service on this basis.

4.2  Where we have your consent to do so, subject to your right to withdraw consent. We may send you marketing communications by email or by SMS if you have subscribed to receiving these communications from us in this way. We can send you email content that’s relevant and tailored to you. If you want to opt-out of email tracking at any time, then you can opt-out of receiving marketing emails. We may rely on the ‘soft opt-in’ to send you marketing emails and/or texts without asking for your express opt-in consent.  You can opt-out of our marketing emails any time or by contacting us by email at support@obscureclo.com. Where we process information on the basis of consent, if at any time you want us to stop processing this information, you can withdraw your consent.

5.2  Payments made on our website are processed by third-party payment providers, including Stripe (for card payments) and PayPal. These providers act as independent data controllers for the personal data they process to complete transactions, prevent fraud, and comply with legal obligations. We share only the information necessary to process payments, such as transaction and billing details.

6 Data Storage & Security

6.1  We only retain your personal data for as long as reasonably necessary to fulfill the purpose we collected it for.

6.2  In relation to marketing consents, we may ask for your updated consent from time to time if we have not heard from you in a while to check that you still want to receive our emails or texts. If you decide to opt-out, we will keep a record of this alongside your email address or other contact details to ensure that we do not send you marketing communications going forward.

6.3  Some of our service providers are based outside the UK or European Economic Area (EEA), meaning your personal data may be transferred internationally. Where this occurs, we ensure appropriate safeguards are in place, such as standard contractual clauses approved by the UK Information Commissioner’s Office.

7 Rights Over Your Data

7.1  You have certain rights in respect of the personal data that we process about you (where we are the data controller because we determine the purpose and means for which that personal data shall be processed):

We may also contact you to ask you for further information in relation to your request to speed up our response. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

7.4  We will try to respond to all legitimate requests within one month. Occasionally, it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
